Terms of Service

1. Purpose

GestoclocPro is a SaaS (online software) business management platform offering, depending on the plan subscribed: invoicing, stock management, till (POS), OHADA accounting, equipment rental, customer management and online store. These Terms govern access to and use of the service by any business customer ("the Customer").

2. Access to the Service and Registration

Access to GestoclocPro requires creating a business account with accurate and up-to-date information (company name, representative, contact details). The Customer is responsible for the confidentiality of their credentials and any activity carried out from their account.

3. Subscriptions, Free Trials and Pricing

GestoclocPro offers several subscription plans (monthly or annual), with pricing shown on the "Pricing" page of the site. Some plans offer a free trial period, with no commitment, before any payment. At the end of the trial, continued use of the service requires subscribing to a paid plan.

4. Payment

Subscription payments are made online via our payment provider PayTech, which accepts Orange Money, Wave, Free Money and Wizall among others. GestoclocPro does not store any banking data: this information is processed directly by the payment provider, according to its own security conditions.

5. Customer's Obligations

The Customer agrees to use the service in accordance with its intended purpose, not to attempt to compromise its security, not to post unlawful content, and to respect the rights of third parties (particularly in the content of their online store, where applicable).

6. Availability and Maintenance

GestoclocPro uses reasonable means to ensure the availability of the service, without guaranteeing continuous, uninterrupted access. Planned or corrective maintenance operations may cause temporary unavailability.

7. Ownership of Customer Data

Data entered by the Customer (products, customers, invoices, accounting entries, etc.) remains their exclusive property. GestoclocPro acts as a technical service provider and only uses this data to perform the service, unless otherwise agreed.

8. Termination

The Customer may terminate their subscription at any time; termination takes effect at the end of the current period, with no pro-rata refund unless otherwise stated. GestoclocPro reserves the right to suspend or terminate an account in the event of a serious breach of these Terms.

9. Liability

GestoclocPro cannot be held liable for indirect damages resulting from the use of the service, nor for the consequences of incorrect data entry by the Customer. GestoclocPro's liability, if established, is limited to the amounts paid by the Customer under their subscription.

10. Changes to these Terms

GestoclocPro may modify these Terms at any time. Customers will be informed of any substantial change; continued use of the service after such a change constitutes acceptance of the new Terms.

11. Governing Law and Disputes

These Terms are governed by Senegalese law. Failing an amicable resolution, any dispute falls under the jurisdiction of the Senegalese courts.
